Notice of Privacy Practices (HIPPA)

Effective Date: 5/28/25

Potere Health MD ("we", "our", or "us") is committed to protecting the privacy and confidentiality of your personal and health information. This Privacy Policy outlines how we collect, use, and safeguard your information in compliance with the Health Insurance Portability and Accountability Act of 1996 (HIPAA).

1. Protected Health Information (PHI)

We collect and maintain health information about you to provide quality care and comply with legal requirements. This includes information such as your medical history, treatment plans, and personal data necessary for healthcare operations and billing.

2. How We Communicate With You

We use several communication platforms to ensure your information remains private and secure:

  • In-Person Visits: All in-clinic visits are conducted in a confidential setting.

  • Telehealth Services: Virtual visits are conducted through Tebra, a secure, HIPAA-compliant telehealth platform.

  • Phone Calls: You may contact our clinic by phone. We will confirm your identity before discussing protected information.

  • Patient Portal: You may securely communicate with us via the Tebra patient portal, which is HIPAA-compliant and offers secure messaging, appointment scheduling, and access to health records.

3. Third-Party Services

We use Tebra as both our Electronic Health Record (EHR) system and Telehealth platform. Tebra is fully HIPAA-compliant and designed to securely manage patient data and virtual care.

4. Text Messaging Policy

Please be advised that text messaging is not HIPAA-compliant. This means that any health information shared via text may not be secure and could potentially be accessed by unauthorized individuals.

If you wish to communicate with us via text message:

  • You must sign an Informed Consent for Non-HIPAA Compliant Communication, acknowledging that texting is not a secure method and accepting the associated risks.

  • You may request and sign this consent, or revoke it, at any time.

5. Data Security and Risk of Data Breaches

While we take extensive precautions to protect your health information, including using the HIPAA-compliant platform Tebra, it is important to recognize that data breaches and cyber threats are an increasing risk in today’s digital environment.

  • We utilize industry-standard encryption, secure servers, and strict access controls through Tebra to minimize the risk of unauthorized access to your information.

Despite these protections, no system is completely immune to breaches, and we will notify you promptly if a breach affecting your information occurs, in accordance with legal requirements.

6. Your Rights

As a patient, you have the right to:

  • Access and request a copy of your health records.

  • Request corrections to your health records.

  • Request confidential communications in a manner of your choosing.

  • File a complaint if you believe your privacy rights have been violated.
